A Organização Mundial do Comércio (OMC) foi criada pelo Acordo de Marraquexe de 15 de Abril de 1994 para substituir o GATT de 1947. Os graves danos causados ao ambiente pelas actividades comerciais são certos e visíveis para todos, e é neste sentido que a OMC, enquanto organização económica líder, integrou as preocupações ambientais na sua política comercial. Tomou estas considerações em consideração, tanto a nível normativo como litigioso. A nível normativo, certas disposições legais contidas em alguns acordos comerciais são dedicadas à protecção ambiental. A protecção do ambiente pela OMC reflecte-se também a nível litigioso através da resolução de alguns casos comerciais com implicações ambientais pelo ORL.
