On March 27, 2007 U.S. Secretary of State Condoleezza Rice reiterated her call for a viable Palestinian state, an allusion to the stance taken by many supporters of the Palestinian cause that any future state must be territorially contiguous. Since the notion of a safe passage between Gaza and the West Bank was first introduced in the Oslo-era, it has gained widespread acceptance as a prerequisite of any political solution between Israel and the Palestinians. A close examination, however, of both the relevant international law and the security concerns of Israel reveals that a safe passage connecting Gaza to the West Bank, sovereign or not, is at best a non-compulsory accommodation to Palestinian economic and humanitarian aspirations and at worst a security peril to Israeli cities and infrastructure. Fundamentally, international law does not require territorial contiguity for a state to be legitimate. Indeed, there are many examples of nations that have foreign land masses or bodies of water separating the components of their entity. Moreover, given the scale of Palestinian arms and explosives smuggling and the Palestinian Authority s inability (or lack of desire) to counter the resultant anarchy, any safe passage between Palestinian territories would risk an arsenal of weapons, not to mention terrorist know-how, reaching the West Bank, and as a consequence endangering virtually all Israeli population and industrial centers. If the Palestinian leadership were to break with its disastrous policies of the past and engage Israel with constructive diplomacy, it might be possible to chart a better future for both sides. But as long as safe passage would facilitate entry for terrorists and their weapons on the outskirts of Israel s major cities, the best intentions of Secretary Rice, and others like her, have scant prospects of success.
