Excerpt: . . . world-wide crusade designed to secure themselves the sole right to use the word Pilsener--a crusade which has extended even to America--a review of the struggle in the German courts, which has finally led to the overthrow of their claims, will be of interest. Among those attacked by the Pilsen breweries were the Brauerei Engelhardt in Berlin, the Bohmische-Brauhaus-Knoblauch in Berlin, the Bavaria-Brauerei of Altona, and particularly the Raderberger Aktien Brauerei in Raderberg near Dresden, the competition of which was especially feared by the Pilsen men. The court was requested to prohibit the Brauerei Engelhardt from labeling its pale beer as Engelhardt Berliner Pilsener, the Bohmische Brauhaus from employing the word Pilsator on its label, the Bavaria-Brauerei from employing the phrase Pilsener-Hansa-Quell and the Raderberger Brauerei from labeling its beer as Raderberger Pilsener, or using the word Pilsener in any other connection. These cases came first before the Chamber of Commerce in Berlin, which refused the demands of the plaintiffs, but the next higher court (Kammergericht) found against the defendants. The plaintiffs also won a decision against the Altona Brauerei in the Oberlandsgericht of Kiel. This latter court pronounced against the use of the word Pilsator, giving it as the opinion of the court that the first syllable Pils was intended to imply that the beer so labeled was brewed in Pilsen, which was not the case. The Kammergericht took the standpoint that the expression Pilsener designated not merely a type or character, but was a term implying origin, which could only be used for beer brewed in Pilsen itself.
